TERMS OF USE

App: AI Pet Assistant

1. Introduction

Welcome to AI Pet Assistant (hereinafter referred to as the "App", "Service"). These Terms of Use (hereinafter referred to as the "Agreement") govern the relationship between you (hereinafter referred to as the "User") and the app developer (hereinafter referred to as "Developer", "We") regarding the use of the AI Pet Assistant application.

By downloading, installing, or using the App, you confirm that you have read, understood, and agreed to be bound by the terms of this Agreement. If you do not agree to the terms, you must immediately stop using the App.

2. Description of Services

AI Pet Assistant is a mobile application providing tools for pet care, including but not limited to:

• Creating pet profiles (storing medical data, notes, feeding schedules).
• Weight tracking and health dynamics monitoring (supporting both Metric and Imperial systems).
• Laboratory results management and AI interpretation based on text, photos, and documents.
• Analysis of food composition by photo of the label (OCR Scanner) and automatic check for allergens.
• AI analysis of pet health and condition.
• Interactive chat with an AI assistant for recommendations.
• "AI Chef" tool for ingredient recognition and personalized recipe generation.
• Interactive virtual pet playroom ("Companion" module) with AI-generated daily diaries.
• Online veterinary appointment manager ("VetBooking" module) integrated with UVS (Unified Veterinary Service).
• Pack management (sharing pet profile access) and finding friends by phone number.
• Discussion of news and social materials in comments.
• Reminders for vaccinations and medications.

3. MEDICAL DISCLAIMER

IMPORTANT: The App does not replace a professional veterinarian.

• 3.1. All recommendations, advice, analyses, reports, and research interpretations generated by the App (including AI chat, photo, and document analysis) are for informational and reference purposes only.
• 3.2. Artificial Intelligence (AI) used in the App may make mistakes, "hallucinate," or provide inaccuracies.
• 3.3. It is prohibited to use the App for diagnosing or treating acute conditions. In case of animal illness, injury, or suspicion thereof, you must immediately contact a veterinary clinic.
• 3.4. AI interpretation of lab results is a supportive tool and cannot be a basis for prescribing or changing treatment without consulting a veterinarian.
• 3.5. The Developer is not liable for any damage to the pet's health resulting from actions taken by the User based on information from the App.
• 3.6. All calorie calculations and recipes generated by "AI Chef" are for recommendation purposes only. Measurements are formatted based on your selected measurement system (metric or imperial). Recommendations may align with nutrition guidelines such as AAFCO (Association of American Feed Control Officials) or FEDIAF, but the Developer is not responsible for allergic reactions or individual intolerance. The final safety decision rests with the owner.
• 3.7. Special disclaimer for "Food Scanner": The module uses OCR technology to recognize text on the packaging. The quality of recognition directly depends on the photo clarity, lighting, and label condition. The Developer does not guarantee 100% accuracy in identifying all ingredients. Information about allergens in the food is for reference and does not replace the owner's study of the composition. The final decision on the safety of the food for a specific animal is made only by the owner.
• 3.8. VCPR and AI Medical Responsibility Disclaimer: The use of the App, including any interactions with the AI assistant, AI Chef, or other features, does not establish a Veterinary-Client-Patient Relationship (VCPR) between you and the Developer or any AI provider. The App is not a veterinary clinic, does not practice veterinary medicine, and does not provide clinical diagnoses, treatments, or prescriptions. All AI-generated responses are automated suggestions and must not be used as a substitute for professional veterinary advice, diagnosis, or treatment that requires physical examination by a licensed veterinarian.

4. Registration and Security

• 4.1. Full functionality requires registration using an email address and a phone number.
• 4.2. You are required to provide accurate information during registration.
• 4.3. The App uses email verification (OTP code). You are responsible for the security of access to your email.
• 4.4. The phone number is used as an identifier for connecting with other community members and forming your pet's "Pack".
• 4.5. We reserve the right to block or delete an account if we detect suspicious activity or violation of the Agreement terms.

5. Subscriptions and Limitations

• 5.1. Free Plan: Provided with limitations (including limits on daily AI requests).
• 5.2. Paid Subscription (Pro): Provided for periods of 1 month, 6 months, or 12 months. Includes extended features, unlimited AI requests (within fair use policy), and priority support. Terms and price are indicated on the purchase screen.
• 5.3. Subscription payments are processed through app stores (App Store) or integrated payment gateways. Cancellation and refund terms are governed by the rules of the respective platform.
• 5.4. Usage Limits: The App implements technical limits on request frequency (RPM — requests per minute) to protect against spam. Access may be temporarily suspended if limits are exceeded.
• 5.5. Playroom Trial Period: The virtual pet playroom companion feature includes a 7-day trial period (the start date is tracked via your account profile). Upon expiration, access to certain playroom features may require an active Pro subscription.

6. User Content and Data

• 6.1. You retain rights to all data and photos you upload to the App.
• 6.2. When posting comments in discussion sections, you agree to maintain standards of decency, not to use profanity, not to insult other participants, and not to spread spam or false information.
• 6.3. AI Moderation: All comments undergo automatic verification by Artificial Intelligence models. The Developer reserves the right to remove any content deemed harmful or in violation of the Agreement rules without explanation.
• 6.4. By uploading pet photos and text data, you grant us a non-exclusive license to use, process, and transfer them to third parties (AI service providers, such as Google Gemini) solely for the purpose of Service operation (generating reports, analysis, and content moderation).
• 6.5. We take strict measures to protect your data, including phone number encryption and HTTPS protocols; however, data transmission over the Internet cannot be guaranteed to be 100% secure.

7. Intellectual Property

• 7.1. The design, source code, logos, texts, and other elements of the App are the intellectual property of the Developer and are protected by copyright law.
• 7.2. Copying, modifying, decompiling, or attempting to extract the source code of the App is prohibited.

8. Third-Party Services

• 8.1. The App uses APIs of third-party services (including but not limited to Google Gemini AI, Firebase/APNs for notifications).
• 8.2. We do not control and are not responsible for the availability and quality of third-party services. Failures in their operation may lead to temporary unavailability of App functions.

9. Limitation of Liability

• 9.1. The App is provided on an "as is" basis. We do not guarantee that the App will work error-free or uninterrupted.
• 9.2. To the maximum extent permitted by law, the Developer is not liable for any direct, indirect, incidental, or punitive damages arising from the use or inability to use the App.

10. Changes to the Agreement

• 10.1. We have the right to update this Agreement. The new version becomes effective from the moment of its publication in the App.
• 10.2. Continued use of the App after changes are made means your consent to the new version of the Agreement.

11. Refund Policy

• 11.1. General Refund Rules: Since AI Pet Assistant provides intangible, digital Software-as-a-Service (SaaS) products, all purchases and subscriptions are generally non-refundable after consumption of AI credits, unless required by local consumer protection laws.
• 11.2. Right of Withdrawal (European Union & UK Customers): If you reside in the European Union (EU) or the United Kingdom (UK), you have a legal right to change your mind and receive a full refund within 14 days of your initial purchase (the "cooling-off period"). However, please note that if you log in and actively generate AI recipes, analyze clinical documents, or use AI chats during these 14 days, you express consent to begin using the service immediately, and you waive your right to a full refund.
• 11.3. Subscription Cancellation: You can cancel your PRO subscription at any time. Upon cancellation, your PRO features will remain active until the end of your current billing period. We do not offer prorated refunds for unused days within an active billing cycle.

12. Contacts and Support

• 12.1. Technical support chat is implemented via integration with Telegram. By sending a message to support, you agree that it will be processed by operators via a third-party messenger.
• 12.2. Kazakhstan: This Agreement and the use of the App in the Republic of Kazakhstan are governed by the laws of the RK. Users from Kazakhstan confirm their consent to the terms of the Service, including cross-border data transfer.
• 12.3. Governing Law and Dispute Resolution: Except where prohibited by local consumer protection laws (such as in the European Union or Kazakhstan), this Agreement and your use of the App shall be governed by the laws of the State of Delaware, USA, and any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
